When foreign direct investment (FDI) and site-selection teams arrive with a shortlist of Indonesian locations, the most common error is confusing land-use designations with fiscal tax incentives.

In Indonesia, “industrial zone types” do not exist on a single, unified list. Instead, they operate on two separate legal systems that frequently borrow each other’s vocabulary. A single project site can hold a status in both systems simultaneously:

  1. Spatial (Land Use): Run by the Ministry of Industry, this system decides where an industrial facility may lawfully be built.
  2. Fiscal and Customs (Tax): Run by the Ministry of Finance and the KEK National Council, this system determines what tax, duty, and import treatments apply once your facility is operational.

This comprehensive guide covers both frameworks, details the critical regulatory shifts introduced by PP No. 20/2024, and outlines exactly which zone type a manufacturing project actually needs to succeed.

What “Industrial Zone Type” Actually Means in Indonesia

Indonesia’s industrial zones are divided into a spatial hierarchy and a fiscal overlay, originating from entirely different bodies of law.

The spatial hierarchy sits under the Industry Law (Undang-Undang No. 3 of 2014). It governs spatial planning, land designation, and the baseline obligations an estate developer owes its tenants (such as serviced land, power, and water). It dictates nothing about corporate taxes.

The fiscal overlay sits under separate finance statutes. It dictates customs treatment, import duties, Value Added Tax (VAT), and income tax inside a defined geographic boundary. It says nothing about whether the physical ground is actually serviced or buildable.

A single site can carry both. For example, a site in Central Java might be both a licensed industrial estate (spatial) and a Special Economic Zone (fiscal). However, they fail differently: a tax-privileged KEK boundary over a plot of land with no power connection is financially useless if you are forced to wait two years for the grid to reach you.

The Spatial Tiers Under PP 20/2024

On May 7, 2024, Indonesia’s spatial industrial zone rules changed significantly. Peraturan Pemerintah (PP) No. 20 of 2024 on Industrial Regionalisation (Perwilayahan Industri) was issued, officially revoking the older PP No. 142 of 2015 on Kawasan Industri. (Note: Much published guidance online still incorrectly cites the 2015 rules, so verify the date of the resources your legal team relies on).

Where the old rules covered only industrial estates, PP 20/2024 covers comprehensive industrial regionalisation across growth centres, designated land, and estates. Licensing has also modernized; the old dedicated estate permit (IUKI) is now folded into ordinary business licensing through the government’s central OSS-RBA portal.

Here are the four spatial tiers that matter for a manufacturing project:

TierIndonesian TermWhat It IsWhat It Decides For You
WPIWilayah Pengembangan IndustriTen development regions (graded: advanced, developing, potential I and II).Where national policy and major infrastructure spending is directed.
WPPIWilayah Pusat Pertumbuhan IndustriGrowth centres inside a WPI, potentially designated as nationally strategic.Extra facilities and government support for companies located inside.
KPIKawasan Peruntukan IndustriLand legally designated for industry in the regional spatial plan (RTRW).Whether industry may lawfully be built there at all.
Kawasan IndustriKawasan IndustriA managed, licensed industrial estate with shared infrastructure.Whether your plot arrives serviced, and who is legally responsible if it is not.

Note: The ten WPI are geographic, not administrative. For instance, the regulation lists northern Sumatra separately from southern Sumatra, a distinction that matters heavilywhen weighing a Sumatran site against a Javanese one.

The Fiscal Overlays: KEK, FTZ, Bonded Zones, and PLB

The second family of Indonesia industrial zone types changes tax and customs treatment. Each status is granted by a different authority based on specific qualifying conditions.

OverlayIndonesian TermLegal BasisGranted ByCore Benefit
Special Economic Zone (SEZ)Kawasan Ekonomi Khusus (KEK)UU No. 39/2009 & Zone-specific regulationKEK National Council (by decree)Tax, customs, and immigration facilities mapped specifically to the zone’s designated sector.
Free Trade ZoneKawasan Perdagangan Bebas (KPBPB)UU No. 44/2007Central Government (by statute)Deemed outside the customs territory; goods entering are not classified as imports.
Bonded ZoneKawasan BerikatFinance Ministry bonded stockpiling rulesDirectorate General of Customs and ExciseDuty and VAT suspension on imported inputs meant for export production.
Bonded Logistics CentrePusat Logistik Berikat (PLB)Same bonded frameworkDirectorate General of Customs and ExciseImported goods can be held tax-suspended before domestic release or re-export.

Three Due Diligence Points for CFOs:

  1. Scope Constraints: A KEK spans manufacturing, tourism, logistics, and digital economies, whereas a Free Trade Zone (FTZ) is strictly for trade and export manufacturing. (Indonesia’s FTZs are strictly limited to Batam, Bintan, Karimun, and Sabang).
  2. Sector Mapping: KEK incentives are tied to the specific sector named in its founding regulation. A chemical plant operating inside a tourism-designated KEK will not inherit tourism tax incentives.
  3. Authority to Grant: No private estate developer can grant KEK status, bonded status, a tax holiday, or a tax allowance. These are strictly government instruments with published thresholds. A developer can build infrastructure to support an application, but they cannot deliver the fiscal decision. A developer who blurs this line is telling you something useful about their other claims.

Which Zone Type Does Your Project Actually Need?

Chasing every available status can cost more in compliance overhead than it returns. Work through the industrial zone types in this specific order:

  1. KPI Designation (First): Confirm the parcel is designated for industry in the local RTRW. If it isn’t, nothing else matters. This is a strict document check at the local planning office, not a verbal conversation with the seller.
  2. Kawasan Industri (The Estate Question): Choosing a licensed Kawasan Industri transfers the heavy lifting for roads, power, water, and effluent treatment to a party contractually obliged to supply them.
  3. Bonded Status (If You Genuinely Export):Kawasan Berikat pays back highly if the majority of your inputs are imported and your output leaves the country. If you sell primarily to the domestic Indonesian market, the compliance overhead outweighs the tax suspension.
  4. KEK (If the Sector Matches): Only pursue this if the zone’s foundational regulation matches your exact industry. Do not rely on the program’s general marketing descriptions.
  5. FTZ (If the Geography Works): Only applicable if your supply chain routing works for Batam, Bintan, Karimun, or Sabang.

The Sequencing Reality: Land title, environmental approvals, and utility tie-ins run on strict timelines that do not compress. These physical realities are the usual reason a plant opens late, not fiscal status. Duty relief on unbuildable ground saves you nothing.

Where SIIPE Sits Among Indonesia’s Industrial Zone Types

The Sumalacca Integrated Industrial and Port Estate (SIIPE) is a planned 5,600-hectare integrated industrial estate, bulk port, and township located on the Strait of Malacca in Medan Belawan, North Sumatra. Currently, roughly 840 hectares have been acquired, with approximately 4,760 hectares remaining for acquisition or reclamation.

Here is exactly where SIIPE stands against the frameworks above:

  • As a Kawasan Industri: SIIPE is developed by Internusa (a Medan developer since 2004) and Asia Capital Pte. Ltd. (Singapore). Estate infrastructure covering water/wastewater treatment, power, gas, fibre optics, roads, fire response, a jetty, and chemical storage is planned (not yet built), and building it is one of the project’s two current priorities.
  • As a KEK or Free Trade Zone: SIIPE does not currently hold KEK or FTZ status. Applications for a Free Trade Zone and KEK license sit among the arrangements still in process for the land yet to be acquired, alongside reclamation licenses and land certification. (For context, KEK Sei Mangkei, 148 km away, currently holds the status SIIPE has applied for). We will not call the estate a Special Economic Zone until it legally is one.
  • As a Bonded Facility: The Sumalacca Dry & Liquid Bulk Port (SDLBP) is planned to be Sumatra’s first integrated customs facility, conceptually including a Bonded Logistics Centre (PLB). Designed at -8 to -10 m LWS with a 13-nautical-mile approach channel, it is tailored for Handysize and smaller Supramax vessels. None of it operates today.

What is factual today is the geography. Belawan Port is just 4.7 km away (about 10 minutes by road), and the masterplan places every industrial plot within 5 km of SIIPE’s planned internal jetty.

Frequently Asked Questions

What are the main industrial zone types in Indonesia?

Indonesia runs two overlapping systems. Spatially, PP No. 20/2024 sets out WPI development regions, WPPI growth centres, KPI industry-designated land, and Kawasan Industri estates. Separately, KEK, free trade zones, bonded zones, and bonded logistics centres apply tax and customs treatment to a defined area. A site can hold both.

What is the difference between a Kawasan Industri and a KEK?

A Kawasan Industri is a physical, licensed, and managed estate supplying serviced land and shared infrastructure. A KEK (Special Economic Zone) is a fiscal and administrative regime applied to an area by government decree. One gives you buildable ground, while the other changes your tax position.

Which regulation governs industrial estates in Indonesia now?

PP No. 20 of 2024 on Perwilayahan Industri, issued May 7, 2024, under Industry Law No. 3 of 2014. It revoked PP No. 142 of 2015 and widened the framework from estates alone to broad industrial regionalisation. Guidance citing only the 2015 regulation is legally out of date.

Does an industrial estate grant tax incentives?

No. Tax holidays, tax allowances, bonded status, and KEK designation are granted by government authorities against published qualifying conditions, never by the private estate developer. Verify every incentive claim directly with the granting authority.

Is SIIPE a special economic zone?

No. SIIPE does not hold KEK or free trade zone status today. A Free Trade Zone and KEK licence is actively in process for land yet to be acquired.
